Hi all,bought a 330i a moth ago from "Harris of Wakefield " after a week the car ran rough and the engine management+oil lites came on.had the car checked at darren woods (bmw) who highlighted a no of faults,2 ltrs too much oil in engine ,pas fluid almost empty( pressure pipes leeking) engine crankase system blocked,and excessive wear in wishbone bushes,etc .£600/£700 to put right.
At the point of sale was told the car would be checked over as part of there 3 month "AUTOTRUST WARRANTY " and as i paid on my credit card thought -yep peace of mind. Rang the dealer about the defects who said contact the warranty people,turns out that Autotrust ceased dealing with them sometime before, therefore the warranty was non existant and fraudulent.contacted the dealer again very evasive but said bring it back and they would look at it.
In the mean time took it for an mot to double check on the faults ,and it failed ,on the problems darren woods discovered.i have since rang the dealer on a number of occasions to discuss but there always busy and keep promising to ring me back,---i dont think so. Ran a co check on them and they are shown as being dissolved on 3 different searches. Contacted trading standard and theyre not interested,been on to lloyds tsb credit card fraud and there disputes department and wont help because initially the dealer said bring it in for repair.i dont want to go back as its obvious theyre a load of crooks and who knows what may happen. An impulse buy has left me with one big headache and more£££ to shell out. SO BE WARNED

I only live a couple of miles away from them too but which site was it, was it the Renault/Nissan dealer near Jn39 M1 or the Volvo/Kia dealership otherside of town.?

Harrats have always been in Wakefield since the 70's and I can remember my Dad buying a car off the original founder when it was just a small secondhand dealershop with half a dozen cars on the forecourt so I am astonished about you saying they have gone under several times but I suppose jo public doesn't always see what goes off behind the scenes.

Hi Ian .wrong dealer its Harris of wakefeld.Agbrigg rd.Im so frustrated at my self for being impulsive but very annoyed that there is no help dont understand if they were dissolved how come theyre still trading and using the services of credit card companies.

Hi - sorry to read of terrible situation.

Have just looked on Companies House register which shows info below.

HARRIS OF WAKEFIELD LIMITED

Company No. 05188412
Status: Dissolved 08/02/2011

Presume you have a receipt or agreement which shows Company Number they are trading under. If it's the same as this then I think it's fraud. If not what are they registered under? Why not get some legal advice - Citizens Advice Bureau would be free for starters .

Further to jonco's info looked at the invoice and no co number anywhere but the name is now Harris of wakefield.
They dropped the LTD. But cant find any record of them. By buying on my credit card i mistakenly thought this offered some protection but tsb dont want to know.So i either drive up there and have more aggro.or just get it fixed myself.

However, just because TSB "don't want to know", doesn't mean that they don't have some liability here.
I'm not 100% sure of the rules (maybe someone else can help?) but I'm pretty sure they can't just turn their back on you - although this is often a first response.
If you used your card to buy the car, then your contract is with the card company, their contract is with the garage.

Does any Company or Vat registered no appear on the credit card receipt if it's not on invoice?

Cheers jonco.that last link looks very helpfull.will give it a go tomoz.
Whilst the car only cost £2495. I put £2415 .on the card. And as they wont return my calls looks like i'll be persuing tsb.
To be honest if i could get the car fixed at no cost to myself i would be happy as is quite a nice motor once these issues are put right..

Sorry Maurice don't know why I read it as Harretts, are they the place near the traffic lights onto Doncaster road.?

Never dealt with them so cant comment but there a few dodgy places around Wakey unfortunately.

Mozz i would def go and confront them but make it on a Saturday and if poss when other people are around, as they wouldnt want a disgruntled customer when they have other potential buyers on the plot.

Hi Moz just read your tales of woe, bleeding disgusting what traders can do and get away with, or try too!!
I'm thinking that you took out insurance cover for it or anyway on your zed. Well if you got legal cover included they will act on your behalf, give them a ring Moz and you will have help in dealing with this.

Just TELL the credit card company you wish to start a section 75 claim. This is a legal right and they cannot reject a claim. They then have a legal responsibility to investigate. Your claim is that the goods are not fit for intended purpose. Your proof a failed MOT.

Ps I would also inform the garage you are reporting them to HMRC for VAT fraud. There turnover will be over the threshold and they legally have to disclose their vat number on the invoice. That may kick them into sorting you out.

Many thanks guys for all your support on this matter,and to jonco and jonttt.for their advise,overall it looks sec 75 is the way to go,so i will attend to that this morning. The dealer wont return my calls anymore so that suits me as i dont want anymore dealings with them . They have proved by their actions so far they are just crooks and connmen and you cant reason or talk to people like that . Just keep hearing the old saying "BUYER BEWARE",Not like me to get taken like this.....Must be getting OLD.

Well just sent my letter/email to lloydstsb card services and making a claim under sec 75 ,so we"ll see what happens
