So you're testing a car and you see this, does it fail ?

Nasty. Tyre has 7mm of tread and very even wear though.

Fail because too close to sidewall and cannot be repaired?

Its in the tyre where most tyre repair places would advise it was scrap as its too close to the wall.. Saying that i'm going with a pass on the grounds it probably some strange ruling in the Mot guide book and its an advisory ?

I'm going to say if it can be repaired it's an advisory. And if it can't be repaired it's a fail.

I think that can be repaired because it's on the tread and not the sidewall. So I think it's an advisory.

I would say fail, as I had a nail in a similar position and the tyre people I took it to would not repair it.
Mind you, the tread was a lot more worn on mine so they probably thought it wasnt worth fixing.

Advisory unless the tyre is severely compromised. The tyre is otherwise satisfactory in tread depth and condition so passes the MoT requirement.
Unless the screw is very small and not penetrated the tyre core the tyre itself is likely to be a write-off as it can’t be repaired.

Tyre is not repairable with a standard minor repair ( only carried out on central 3/4 ) to fix that would need a specialist vulcanised repair and on a tyre like that would cost more than the worth .

I only knew because a guy at work had this on his MOT check. He had a dangerous fail for imbalance, but an advisory for a nail in the tyre:wideyed:.
You are right even though the tyre can't be fixed most nails and screws leak slowly if tyre holding air and no other fail criteria caused by it's presence ( for example it had went in at an angle then got pulled straight ripping the tyre and exposed cords ) then pass and advise.
