A no-brainer for many reasons - 100% Audi's fault.
No doubt that the Audi is at fault, he hit a stationary car, period. It won't stop his insurance arguing that his client hit an illegally parked car though.

...that was the other side of a solid white line. It is no different than if it were parked in the middle of a farmer's field without permission.

The Audi had no legal right to be on that part of the tarmac.

I can see your argument, and if I were trying to lessen the Audi driver's blame, it is the argument that I would use.

You might be surprised how far an insurance company is prepared to argue the blame for that. The estate car was not only on yellow lines but also up on the pavement and blocking what looks like a cycle lane.

I'm not saying the R8 driver was anything less than a complete tool but unless the estate car had a breakdown or other emergency it shouldn't have been where it was.

Probably end up as knock for knock as both cars are in positions they were not legally entitled to be in then both insurance company's will refuse claims for illegal maneuvers and keep the premiums

Some knock though - could have been much worse - thankfully the children were more or less alright!

I just wonder how much the insurance costs to hire that car,and what conditions, if any excess do they take that at start of hire.
